In Greene County district court Kevin Armando Montoya, 19, of Grand Junction was sentenced to two years in prison after he pleaded guilty to a charge of criminal mischief- third degree. The prison term was suspended and he was placed on probation for two years. Montoya was fined $625 with a $218.75 surcharge and a $125 Law Enforcement Initiative surcharge. He must pay $78 restitution for his court appointed attorney’s fees and $161 court costs.
A companion case in magistrate court in which Montoya was charged with theft-fifth degree was dismissed. Montoya must pay $60 court costs in that case.
Montoya was initially charged with burglary- third degree and criminal mischief- first degree. (Sentencing: Honorable Adria A. Kester)
Persons pleaded not guilty at arraignments as follows: Kathryn Lynn Welch, 52, of Grand Junction, possession of marijuana- second offense; John Douglas Reed, 33, of Jefferson, criminal mischief- third degree; Jasmine Fluker, 27, of Jefferson, possession of methamphetamine- first offense, and the same charge in a second case; Freedom Hope Ore, 34, of Jefferson, domestic abuse assault display or use weapon; and Charles Edward Henderson, 24, of Jefferson, possession of marijuana- first offense. Trial dates were set for Sept. 27 in every case.
Cases were initiated in district court as follows: Christopher Herbert Lawrence, 36, of Jefferson, burglary- third degree (motor vehicle), and attempted burglary- third degree (motor vehicle), two counts; Kimberly Marie Smith, 43, of Jefferson, burglary- third degree (motor vehicle), and attempted burglary- third degree (motor vehicle), two counts; Nicholas Anthony Balderas, 24, of Jefferson, domestic abuse assault- third or subsequent offense; Kevin Armando Montoya, 19, of Jefferson, operating while intoxicated- first offense; Fashion Marie Foster, 41, of Perry, theft- fourth degree; and Joshua Harold Gingery, 31, of Churdan, burglary- second degree.
